California Divorce Costs

By Bilal Butt, founder. Last verified: October 2026.

Filing fees are official; total divorce costs are not published by any court. Every total-cost range below is an industry estimate (firm guides and surveys), not an official statistic.

Estimate only — not legal advice, not a court order. Every figure on this page is a guideline illustration. Courts can deviate, impute income, add expenses, and decide differently on the facts. For a real case, consult a licensed attorney in the relevant jurisdiction. Last verified: October 2026.

Filing fees (verified)

Total cost ranges — industry estimates, not official figures

RouteIndustry-estimate range
DIY uncontested$435–$1,000
Uncontested with attorney review$1,500–$3,500 (some CA guides up to $7,500–$9,000)
Mediated$3,000–$15,000
Collaborative$10,000–$25,000
Standard contested$15,000–$50,000
High-asset / complex contested$50,000–$200,000+

California attorney rates are cited in secondary guides at $300–$500/hour. National context (older Martindale-Nolo survey, as cited in 2025–2026 secondary sources): uncontested with a lawyer about $4,100 average total; disputed but settled before trial about $10,600; cases reaching trial $20,400+; overall average about $11,300 — treat the national average as dated, not 2026-precise. Mediation nationally is estimated at $3,000–$8,000 per couple, usually split.

What drives the cost

Conflict level (the single biggest driver), children/custody disputes, business or professional-practice valuation, real estate and retirement/QDRO work, expert witnesses (forensic accountants, appraisers, custody evaluators), discovery, motions and trial time, and geography (metro rates far above rural).

Filing fee and fee relief

$435 base per petition (Statewide Civil Fee Schedule, effective 1 January 2026). The responding spouse pays another $435, so $870 if both file. Joint petition (Form FL-700, from 1 January 2026): $870 total (two $435 fees) — this rests on strong secondary consensus, including an explicit correction that the joint petition does not cut the total in half; the Judicial Council schedule line itself was not directly opened, so that source note is kept here. A higher fee in some surcharge counties is reported in secondary sources citing the same schedule; the $435 base is the verified figure. Fee relief exists for qualifying filers in all four states covered on this site, but relief waives court fees, not attorney fees: California Form FW-001, New York “poor person” relief under CPLR §1101, Texas Statement of Inability to Afford Payment of Court Costs (Rule 145), and Florida's Application for Determination of Civil Indigent Status. Check the current fee schedule for your county or court before filing — fees change and some counties add surcharges.

Service of process

After filing, the other spouse must be served (or must waive service / accept service, where the rules allow). Common methods include personal service by a process server or sheriff, service by certified mail where permitted, and waiver or acceptance of service. Service is a separate step from filing: a petition that is never properly served does not move the case forward, and contested service disputes add time and cost. This page does not publish a service fee figure, because service charges vary by county, method and provider and no single official service fee applies. Budget for service as a separate line item and ask the provider for its charge in advance.

All total-cost ranges in the table are industry estimates from firm guides and surveys, not official statistics. No court publishes a “total divorce cost.” Treat the ranges as planning context, not as quotes: your case moves within or beyond a range according to the cost drivers below.

What drives the cost

Conflict level is the single biggest driver, followed by children and custody disputes, business or professional-practice valuation, real estate and retirement or QDRO work, expert witnesses (forensic accountants, appraisers, custody evaluators), discovery, motions and trial time, and geography — metropolitan attorney and mediator rates are far above rural rates. Each disputed issue tends to add a round of drafting, negotiation or hearing time. Settling one issue early (for example, agreeing the parenting schedule while property is still disputed) usually saves more than negotiating every issue at once at the end.

Mediation in more detail

Mediation is a structured negotiation with a neutral mediator who does not decide the case. National industry estimates put mediation at $3,000–$8,000 per couple in total, usually split between the parties, with mediator rates around $100–$500 per hour (attorney-mediators $250–$500 per hour; non-attorney mediators $100–$350 per hour); court-sponsored programmes may be free to $500 where available. Mediation suits cases where both parties can negotiate in good faith and disclose finances fully. It is a poor fit where there is coercion, hidden assets or a refusal to disclose — in those cases, court process and discovery, though more expensive, may be necessary. A mediated agreement still needs to be drafted and entered as an order; that drafting cost is separate.

Common mistakes

When to hire a lawyer

Talk to a licensed attorney in the relevant state before filing if children and custody are disputed, if there is a business, real estate portfolio or retirement division, if either party may hide assets, if there is a history of family violence, or if the other party already has a lawyer. Even in an uncontested case, a short attorney review of the settlement can catch errors in support, tax and property language that are expensive to reopen. This site cannot recommend a specific lawyer and does not take referral fees.
